The rules for using SourcedKit, written so a non-lawyer can read them.
What these terms cover
These Terms of Service ("Terms") govern your access to and use of sourcedkit.com, all calculator pages, the SourcedKit newsletter, and any content or services SourcedKit makes available (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who can use SourcedKit
You may use the Service if you are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and able to enter into a binding contract. The Service is available to users worldwide, except where prohibited by applicable law.
What SourcedKit provides
SourcedKit publishes interactive calculators that produce estimates based on user-provided inputs and source data drawn from primary authorities (such as FDA labels, ACOG guidance, manufacturer documentation, and government regulations). Each calculator cites the source data it uses and displays a last-verified date.
What SourcedKit is not
SourcedKit calculator outputs are estimates only. They are not, and must not be relied on as:
- Medical advice, diagnosis, or treatment recommendations
- Legal advice or interpretation of any law or regulation
- Financial, investment, or tax advice
- Professional consultation of any kind
- A substitute for consultation with a qualified healthcare provider, attorney, accountant, or other licensed professional
- A guarantee of any outcome, eligibility, cost, or timeline
Always confirm any decision that matters with a qualified professional who knows your specific situation.
What you may do with SourcedKit
You may:
- Use any calculator for your personal, non-commercial decision-making
- Cite SourcedKit results in articles, research, reports, or presentations with attribution to SourcedKit and a link to the specific calculator page
- Share calculator URLs (including URLs with input parameters) with others
- Quote short excerpts from SourcedKit content with proper attribution under fair use
What you may not do with SourcedKit
You may not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Republish entire calculator pages, FAQ content, or methodology text without express written permission
- Use automated scraping tools that exceed reasonable rate limits or that bypass technical protection measures
- Attempt to gain unauthorized access to any part of the Service, our servers, or any related systems
- Interfere with or disrupt the Service or any networks connected to it
- Use the Service to transmit viruses, malware, or any other harmful code
- Remove, alter, or obscure any copyright notice, source citation, or attribution displayed on a calculator
- Misrepresent SourcedKit outputs as personalized professional advice from SourcedKit
- Use the Service in a way that could damage, disable, overburden, or impair our servers or networks
Who owns the content on SourcedKit
All content on SourcedKit, including calculator logic, methodology explanations, editorial content, and the visual design, is the property of SourcedKit and is protected by copyright and other intellectual property laws. Source data we cite (manufacturer pricing, government tables, medical society guidelines) belongs to the original publishers and is used under fair use for the purpose of education and citation.
The underlying numerical data sets compiled by SourcedKit are licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). You may reuse the data with attribution to SourcedKit and a link to the specific calculator page.
What about links to third-party sites?
SourcedKit links to third-party websites (manufacturer pages, government sites, medical society guidelines, professional resources). SourcedKit does not control these sites and is not responsible for their content, privacy practices, or availability. Linking does not imply endorsement. Your interactions with any third-party site are subject to that site's own terms and policies.
What does "AS IS" mean here?
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, SourcedKit disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.
While we make reasonable efforts to verify source data and keep calculators up to date (see our editorial standards), we do not warrant that:
- Calculator outputs will be accurate, complete, or current at any given moment
- Source data has not changed between our last verification date and your visit
- The Service will be uninterrupted, secure, or error-free
- Defects will be corrected
What is SourcedKit's liability if something goes wrong?
To the maximum extent permitted by applicable law, SourcedKit, its operators, contributors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of (or inability to use) the Service, including but not limited to:
- Loss of profits, revenue, savings, or business opportunity
- Medical, legal, financial, or other professional decisions made in reliance on calculator outputs
- Loss of data or content
- Cost of substitute services
- Damages resulting from third-party content or links
SourcedKit's total aggregate liability for any claim arising out of or related to the Service will not exceed CAD $100 or the amount you have paid SourcedKit in the 12 months preceding the claim, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.
How does indemnification work?
You agree to indemnify and hold SourcedKit harmless from any claim, demand, loss, or damages, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
How can SourcedKit modify or end the Service?
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms; material changes will be communicated by email to active newsletter subscribers at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Which laws apply to these Terms?
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the courts of Ontario, Canada, unless applicable consumer protection law in your jurisdiction requires otherwise.
What if part of these Terms is unenforceable?
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
